Welcome to Chalamet. These Terms of Service ("Terms") govern your access to and use of the Chalamet platform ("Service"), operated by [COMPANY NAME] ("we," "us," or "our"). The Service connects patients with licensed General Practitioners (GPs) in France for the purpose of receiving medical advice through video consultations.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account and using the Chalamet platform, you confirm that:

2. Description of Service

Chalamet is a digital health platform that facilitates online medical consultations between patients and licensed GPs. Our Service includes:

  • Video consultation appointments between patients and GPs
  • Secure messaging between patients and GPs
  • Appointment scheduling and management
  • Storage of consultation notes and medical advice (for GPs)

3. Medical Disclaimer and Limitations

⚠️ NOT FOR EMERGENCIES: If you are experiencing a medical emergency, immediately call 15 (SAMU), 112 (European emergency number), or go to the nearest emergency room. DO NOT use Chalamet for emergencies.

Chalamet provides a platform for medical advice only. The Service is NOT a substitute for in-person medical care, diagnosis, or treatment.

Consultations through Chalamet are for informational and advisory purposes. GPs using our platform provide professional medical advice based on the information you provide, but they cannot perform physical examinations or diagnostic tests.

NO PRESCRIPTIONS: GPs on the Chalamet platform do NOT prescribe medications, including controlled substances, antibiotics, or any other prescription drugs. If you require a prescription, your GP will advise you to visit a medical facility in person.

The medical advice provided through Chalamet does not create a traditional doctor-patient relationship as defined by French medical law. GPs are independent contractors and are solely responsible for the medical advice they provide.

Service Limitations:

  • No physical examination or diagnostic testing
  • No prescriptions of any kind
  • Not suitable for emergencies, urgent care, or serious medical conditions
  • Not suitable for conditions requiring in-person examination (e.g., suspicious lumps, skin conditions requiring dermatoscopy, chest pain, severe injuries)

4. User Accounts and Responsibilities

To use the Service as a patient, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Providing accurate and complete medical information to GPs
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. If you are under 18, your parent or legal guardian must create the account and accompany you during consultations.

5. GP Accounts and Professional Obligations

GPs using the Chalamet platform must:

  • Be licensed to practice medicine in France and registered with the Ordre des Médecins
  • Maintain valid professional liability insurance
  • Provide accurate and truthful information about their credentials
  • Comply with all applicable medical ethics codes, regulations, and French healthcare laws

GPs are independent contractors, not employees of Chalamet. GPs are solely responsible for the medical advice they provide and any professional liability arising from consultations.

6. Payments, Subscriptions, and Refunds

Payment Models

  • Subscription Plans: Monthly or annual subscriptions providing access to a specified number of consultations or unlimited consultations, depending on the plan selected
  • Pay-Per-Consultation: Pay individually for each consultation at the time of booking

Billing

All payments are processed securely through our third-party payment processor (Stripe). Subscription fees are billed automatically at the start of each billing cycle. You authorize us to charge your payment method on file. Prices are displayed in Euros (EUR) and include applicable taxes.

Refunds and Cancellations

Refund policies vary depending on the payment model:

  • Subscriptions: Monthly subscriptions can be cancelled at any time, but no refunds are provided for partial months. Annual subscriptions may be refunded on a pro-rata basis within the first 30 days.
  • Pay-Per-Consultation: Refunds are available if you cancel at least 24 hours before your scheduled appointment. Cancellations with less than 24 hours notice are not eligible for refunds.
  • If your GP fails to join the consultation within 15 minutes of the scheduled time, you are entitled to a full refund.

7. Appointment Booking and Cancellation

Patients can book appointments with available GPs through the platform. Appointments are confirmed upon successful payment or subscription validation.

Cancellation Policy

  • Patients may cancel appointments up to 24 hours in advance without penalty.
  • Cancellations with less than 24 hours notice may result in forfeiture of payment (pay-per-use) or deduction from subscription balance.
  • GPs may cancel appointments due to emergencies or unforeseen circumstances. In such cases, patients will receive a full refund or credit.

8. Privacy and Data Protection

We take your privacy seriously. All personal and medical information is processed in accordance with the General Data Protection Regulation (GDPR) and French data protection laws.

9. Intellectual Property

All content on the Chalamet platform, including text, graphics, logos, software, and design, is the property of Chalamet or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content on the platform without our prior written consent.

10. Prohibited Uses

You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to:

  • Requesting prescriptions for controlled substances or drugs of abuse
  • Providing false or misleading medical information
  • Using the Service for emergencies or urgent medical care
  • Impersonating another person or entity
  • Interfering with or disrupting the operation of the Service
  • Attempting to gain unauthorized access to any part of the Service or user accounts

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users or the Service.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, you will lose access to your account and any associated data, subject to our data retention policies.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHALAMET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Chalamet, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Governing Law and Dispute Resolution
